It is totally banned to use a mobile phone or even have a cell phone in your possession during a test, especially when you are out on break. Any and all cell phones must be turned off and placed in an individual locker that has been set aside for you. When individual lockers are not available, a Personal Belongings storage table will be set up for the storage of goods that are not allowed on the premises. You will be disqualified if you do not adhere to the regulations of the examination administration.

Section 1798.40(e) of the California Civil Code states that you are not permitted to view your book or answer sheet after the test session has concluded.

If a person brings personal things to the test, they must be put in a storage facility apart from the individual who brought them, as ordered by proctor staff.

Conduct Penalties

A misdemeanor is committed whenever any individual engages in any action that subverts or seeks to undermines any license examination or the administration of an examination, including but not limited to the following:

  1. The conduct of a student that compromises the security of the examination materials
  2. Removing any examination materials from the examination room without authorization
  3. The unauthorized reproduction of any portion of the actual licensing examination by any means
  4. Aiding in the unauthorized reproduction of any portion of the actual licensing examination by any means
  5. Removing any examination materials from the examination room without authorization the payment of or the use of professional or paid examination takers for the purpose of recreating any section of the licensing examination obtain examination questions or other examination material, except with specific authorization, before, during, or after an examination
  6. Or use or purport to use any examination questions or materials that were improperly removed or taken from any examination for the purpose of instructing or preparing any applicant for examination
  7. Or sell, distribute, buy, or receive any portion of a future, current, or previous examination without specific authorization
  8. Or have unauthorized possession of any portion of an examination in the course of a future, current, or previous examination Having in one’s possession any books, equipment, notes, written or printed materials, or data of any kind, other than the examination materials distributed, or being otherwise authorized to have in one’s possession during the administration of a licensing examination are all prohibited. Any prosecution brought according to the power granted by any other provision of law is not precluded by the provisions of this section. Apart from any additional penalties, anybody found guilty of breaking this section will be accountable for the real losses suffered by the agency administering the examination, which will not exceed ten thousand dollars ($10,000) in total, plus the costs of litigation. If any provision of this section or the application of such provision or application to any person or circumstance is found to be invalid, the invalidity of such provision or application shall not affect the validity of any other provisions or applications of the section that can be given effect without the invalid provision or application, and the provisions of this section are severable for this purpose.

If any person has engaged in or is about to engage in any acts or practices that constitute, or will constitut a violation of Section 123, the superior court in and for the county where the acts or practices take place, or are about to take place, may issue an injunction or other appropriate order restraining such conduct on the application of the board, the Attorney General, or the district attorney of the county.

123.5. Chapter 3 (commencing with Section 525) of Title 7 of Part 2 of the Code of Civil Procedure will regulate the procedures brought according to this section.

496.A board may refuse, suspend, revoke, or otherwise limit a license on the grounds that an applicant or licensee has violated Section 123 of the Uniform Commercial Code, which deals with subversion of licensing exams.

It is unlawful for anybody to cheat on, undermine, or try to subvert a licensure examination administered by the Department of Motor Vehicles.

Subversion and cheating on a license examination include, but are not limited to, the following activities: participating in, soliciting, or obtaining any of the following:

  1. The exchange of information between one or more examinees and anybody else, other than a proctor or an examination official, during the course of the examination
  2. Copying answers from another examinee or allowing one’s own answers to be copied by another examinee are both considered cheating. The examination is being conducted by someone other than the applicant for all or part of the time
  3. Remove any examination materials from the examination room without first obtaining authorisation
  4. The unlawful duplication of any section of the real license examination by any means, including photocopying Allowing the unauthorised reproduction of any section of the real licensing examination by any means is prohibited. Possession or use of any device, material, or document at any time during the examination or while the examinee is on the examination premises that is not expressly authorized for use by examinees during the examination, including, but not limited to, notes, crib sheets, textbooks, and electronic devices
  5. Non-compliance with any examination instruction or regulation pertaining to examination security. Providing false, fraudulent, or materially misleading statements about one’s education, experience, or other credentials as part of, or in support of, any application for admission to a test.

(3) For a period of up to three years, the commissioner may prohibit any candidate who willfully cheats on, subverts, or attempts to subvert a license exam from sitting for any subsequent license examination or from holding an active real estate license under any provision of this code for any reason whatsoever. 10153.1.It is prohibited for any person to engage in any deceit or fraud with regard to his or her identification in connection with any examination, application, or request to be examined conducted under the provisions of this section with relation to any examination.

Regulations of the Real Estate Commissioner

The following rules must be followed by any person taking an examination for a license issued by the Department, from the time the examinee enters the examination room until the examinee has completed the examination and exited the examination room: 2763.(a) A person taking an examination for a license issued by the Department must adhere to all of the following rules from the time the examinee enters the examination room until the examinee has completed the examination and exited the examination room:

  1. One may not consult any printed or written materials other than those provided by the Department when taking an examination
  2. Examinees are required to do written computations exclusively on paper provided by the Department for that purpose. In addition, an examinee may not converse with any other examinees or with anybody else other than the examination proctor. An examinee is not permitted to copy questions or make any notes on test materials. In order to leave the examination room prior to the end of the examination, an examinee must first seek the express authorization of an examination proctor, after which all examination papers and supplies must be handed over to the proctor. The only materials or devices that an examinee may use during the course of the examination, other than those provided by the Department, are pencils and slide rules, or silent, battery-operated, electronic, pocket-sized calculators that are not programmable, do not have a printout capability, and do not have an alphabetic keyboard
  3. An examinee is not permitted to share the use of examination materials with any other examinee
  4. And

If an examinee fails to comply with any of the foregoing regulations or verbal commands of an examination proctor, the examinee may be disqualified from further examination and the examiner will be subject to appropriate administrative action, which may include denial of the examinee’s license.

Notification of Examination Results

If you took an electronic examination, your results were emailed to you immediately after you completed the examination. It is possible that you will get additional letters in the mail within five business days of your assessment. To pass the examination, you must properly answer at least one of the following questions:

  • Either 70 percent of the questions (for Salespersons) or 75 percent of the questions (for Brokers)
  • Or

Because the test is of a qualifying nature, examinees who pass are not told of their final result at the conclusion of the examination. Only if you are unsuccessful will you be advised of your exact score as well as the percentage of questions answered properly in each of the subject areas in which you failed. The overall score, on the other hand, cannot be calculated simply averaging the percentages. Those who do not achieve a passing grade on the examination may seek to retake the exam.

Re-taking the Examination

You may seek to retake the examination if you have been notified that you have failed a previous examination. Prior to obtaining the results of this test, do not submit a new application and fee, or otherwise make an attempt to acquire a new examination date by any means. In order to reapply for a new test date, you must first wait until you have received your findings. If you do not adhere to these directions, your exam record will be flagged, and your test results will be withheld while extra fees are charged to you.

After failing an examination, you may submit an application to retake the test using theeLicensing online system (to expedite processing) or through the Examiner’s ResultNotice (RE 418A, Salespersons or RE 418B, Brokers).

In order to avoid forfeiting the money, these forms must not be submitted until after the results of the examination have been made publicly available.

To sit for subsequent exams after the two-year term has expired, you must submit a new application, requalify by completing all of the applicable legislative conditions, and pay the relevant price.
